On December 16th, 2011, this letter was posted on Facebook by Sandy and Larry Kaplan in response to rumors from people within the community about the itegrity of I'm Positive, Inc., Thomas Lahey (our founder and President), our volunteers and our staff.
"It has come to my attention that thru the deceit and lies of two very sick and twisted people, the integrity and honesty of a great man, Tom Lahey, is being doubted. My name is Sandy Kaplan, I was Phil’s mother. When Thomas Lahey approached my husband Larry and I we were at first suspicious. Who is this man and why does he want to help us? Additionally, we asked several of the homicide detectives about this Tom Lahey and his IM POSITIVE INC organization. Tom’s integrity was NEVER as issue with anyone EVER. Without help from anyone else, Larry and I paid Phil’s body transportation charges, mortuary charges, cemetery charges, and the cost of a coffin, plot, and finally the Dolly themed headstone. Thomas Lahey has worked tirelessly to raise money for us. He has not mishandled, misdirected or in any way abused the trust he holds as fundraiser for such an honorable and important cause. Thomas has provided us with financial reports of every dollar in and every dollar out even after we said that was not necessary. He has already paid two of the four bills outstanding and is about to write a check for the headstone. So many of you worked so hard to give of yourselves to raise money for Phil. It sickens me that vicious lies can tarnish the honor and reputation of this incredible organization, their staff, and volunteers. I speak for the entire Berger/Kaplan family when I beg of you not to stop donating. I am aware of an awesome Dolly Parton auction that will be taking place soon, among other of Phil’s possessions. I am hopeful that 100% of our expenses will be paid. I ask you to continue donating for the Memorial Park bench that Thomas has arranged for early spring. Your dollars will also help several of our favorite animal and LGBT charities. I even suggested IM POSITIVE keep anything over and above expenses after everything is paid and Thomas felt it was a conflict of interest. If that isn’t a statement of integrity, I don’t know what is. I hope I have set the record straight. DO NOT EVER GIVE ANY MONEY TO ANYBODY other than Tom Lahey, IM POSITIVE INC and/or the Wells Fargo Bank Account. Understand after ANY fundraiser is over, the person in charge needs to contact Thomas Lahey to give him the money directly or deposit to the Wells Fargo Bank Account. I hope that the people who have lied and been deceitful come to recognize the harm they have done. Apologies to this hero of a man are in order. It is my hope that Thomas and Albert can continue the G-d’s work that they do, thru IM POSITIVE INC knowing that they have not done anything wrong. To all who have given $1.00 we thank you most sincerely. Knowing how much you all cared for our son, showing such kindness and generosity has made this most unbearable situation just a little easier.
Larry and Sandy Kaplan"
